Use of the App

1. Service Description

Our service allows users to upload their selfies and photos containing their face, and we generate AI-enhanced dating images for their personal use.

2. Eligibility

To use our App, you must be at least 18 years old and capable of entering into a legally binding agreement. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

Registration: You may be required to create an account to access certain features of the App. You must provide accurate and complete information when creating your account.
Account Security: You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Account Termination: We reserve the right to terminate or suspend your account at any time, without notice, for any reason, including if we believe you have violated these Terms.

4. User Obligations

By using our service, you agree to:

Use our service only for lawful purposes, in compliance with applicable laws.
Only upload images that you have the right to use. We reserve the right to terminate or suspend access to our service if you upload photos that you do not have the right to use.
Not try to exploit our software to generate inappropriate or malicious images.
Not put our servers through heavy loads or proto denial of service attacks; only use our service for personal use.

Intellectual Property

1. Ownership

All content and materials available on the App, including but not limited to text, graphics, logos, and software, are the property of krzywicki.dev or its licensors and are protected by intellectual property laws.

2. License

We grant you a limited, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use. This license is subject to your compliance with these Terms.

3. Restrictions

You may not:

Reproduce, distribute, modify, or create derivative works of any content or materials on the App without our prior written consent.
Use any data mining, robots, or similar data gathering or extraction methods on the App.

4. User Ownership of Generated Content

Users retain full ownership of the images generated through our service. By using our service, you grant RizzCam a non-exclusive, limited license to process the input and output images for the purpose of providing the service and improving our AI models. We store the images and associated usage data to enhance the functionality of our app and train our AI models. Images are securely stored and may be retained for these purposes unless you request their deletion.

Privacy and Data Protection

We collect and store user-provided data, including selfies and other personal information, to improve the App’s functionality and train our AI models. By using the App, you consent to this data collection and usage.

2. Data Storage and Protection

We are committed to protecting your personal data in compliance with the GDPR. By using our service, you consent to the collection and processing of your data in accordance with our Privacy Policy. Users have the right to:

Request access to their personal data.
Correct or delete their data.
Withdraw consent at any time.

3. Additional Data Collection

We collect basic non-identifiable information that you provide when entering the website, such as device type, web browser, operating system, language, country, etc., to better target our services. We process your email address to send you our service through the Stripe payment gateway and to send you the generated images.

Disclaimers and Limitation of Liability

1. Disclaimers

The App is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the content available on or through the App. We disclaim all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

2. Limitation of Liability

At RizzCam, we try to ensure that our generated photos do not contain any malicious, disturbing, or inappropriate content. Nevertheless, RizzCam shall not be liable for:

Any indirect, consequential, or incidental damages arising from the use of our service.
Any inaccuracies or issues in the generated images.
Accidental generations of malformed, disturbing, or inappropriate images.
Any bugs, viruses, or other harmful code that may be transmitted to or through the App.
Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App.

Indemnification

You agree to indemnify, defend, and hold harmless krzywicki.dev, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

Termination

We reserve the right to terminate or suspend access to our service immediately, without prior notice, for any conduct that we deem to violate these ToS. We reserve the right to terminate our services at any time, without prior notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the country of Poland, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Poland to resolve any legal matter arising from these Terms.

Changes to the Terms of Service

We reserve the right to modify these Terms at any time. Continued use of the service after any changes constitutes acceptance of the new terms. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above.
